Effective date: October 5, 2026 Last updated: October 23, 2026
These Terms of Use ("Terms") are a binding agreement between you and Fixinary ("Fixinary," "we," "us," or "our"). If we later operate the Service through a company we form, these Terms will apply to that company as our successor (see Sections 15 and 17.4). The Terms govern your use of Fixinary's websites, applications, and related services (the "Service").
By creating an account or using the Service, you agree to these Terms (including our Safety Notice) and our Privacy Policy. If you don't agree, don't use the Service.
1. Eligibility and Related Policies
1.1. Who may use Fixinary. You must be at least 18 years old (or the age of majority where you live, if higher) and able to form a binding contract. If you use the Service for an organization, you confirm you have authority to bind it.
1.2. Related policies. Our Privacy Policy explains how we handle personal information. Our Safety Notice at fixinary.com/safety summarizes key safety points from Sections 3 and 4 and is part of these Terms. If it conflicts with these Terms, these Terms control. Specific offers, such as a promotion, may have their own terms. If those conflict with these Terms, the offer's terms control only for that offer, and only if they say so expressly.
2. What Fixinary Is (and Isn't)
2.1. What it is. Fixinary is an AI-powered tool that helps homeowners, renters, landlords, property managers, estate managers, and other users troubleshoot common home problems: identifying likely causes, suggesting steps, and pointing out when a problem needs a professional.
2.2. What it isn't. Fixinary is not a licensed contractor, electrician, plumber, gas fitter, engineer, design professional, or inspector. We do not visit or inspect your property, pull permits, perform work, or guarantee results. Using the Service does not create a professional-services relationship of any kind.
2.3. AI-generated content. Responses are generated by artificial intelligence, including third-party AI models, from what you tell us and show us. AI can be wrong, incomplete, out of date, or overconfident, and it can miss hazards it can't see. Similar questions from different users may receive similar answers.
2.4. Changes and limits. We may add, change, or remove features, and set or change usage limits (for example, diagnosis limits on free and paid plans, or fair-use limits to prevent abuse). The Free plan includes one (1) diagnosis in total. It does not reset monthly or at any other time.
3. Your Responsibility for DIY Work
3.1. Verify before you act. Building codes, manufacturer instructions, and conditions in your home vary. Check Fixinary's guidance against the product manual, labels, and local code before acting on it. When they differ, follow the manual, label, or code.
3.2. Your decision. You decide whether and how to act on anything the Service says. You are responsible for your tools, materials, skill, permits, and compliance with applicable law.
3.3. When to call a pro. For complex, high-risk, code-regulated, or uncertain work, hire a licensed professional who can inspect the problem in person. If Fixinary tells you to stop and call a professional, or declines to walk you through a task, treat that as a hard stop, not a suggestion to find a workaround.
3.4. Acknowledgment of risk. DIY repair carries inherent risks, including injury, fire, and property damage. To the extent permitted by law, you accept the ordinary risks of carrying out repairs yourself. This does not waive claims that the law does not allow to be waived (see Section 11).
4. Safety and Emergencies
4.1. Emergencies. If there is immediate danger to life, health, or property (fire, smoke, a gas smell, electrical shock, flooding that threatens safety, structural collapse risk, carbon monoxide alarm, or a medical emergency), leave the area if it is unsafe and call 911 (or your local emergency number). If you smell gas, get out first and call from outside. Do not use Fixinary in an emergency.
4.2. High-risk work. Electrical, gas, fuel-burning appliances, structural framing, roofs, asbestos, and significant mold work can cause serious injury, death, fire, explosion, or carbon monoxide poisoning. Safety warnings in the Service are not exhaustive. When in doubt, stop and hire a licensed professional.
4.3. Shutoffs. Before any work involving power, water, or gas, follow the manufacturer's and utility's guidance for safely shutting off and isolating the system. If you can't confirm a safe procedure, don't proceed.
4.4. No monitoring. We do not monitor conversations in real time and have no ability or duty to contact emergency services for you.
5. Accounts
5.1. Registration. Give us accurate information and keep it current. Accounts are provided through a third-party authentication provider (see Section 9).
5.2. Security. Keep your login credentials confidential. You're responsible for activity under your account unless you notify us promptly after learning of unauthorized access. We may require extra verification to protect accounts.
5.3. No sharing or evasion. Don't share an account to get around plan limits, create new accounts to evade a suspension or usage limit, or impersonate anyone.
5.4. Suspension and termination. We may suspend or end your access to the Service or your account at any time, for any reason or no reason, with or without notice, to the extent the law allows. If we end a paid subscription for any reason other than your violation of these Terms, we'll refund the unused, prepaid portion. You may stop using the Service and close your account at any time in account settings or by contacting us. Sections that by their nature should survive termination (including disclaimers, liability limits, indemnity, IP, and Section 14) do.
6. Paid Plans, Renewals, Refunds, and Promotions
6.1. Payments. Payments are processed by Stripe (or another processor we designate). Card data is handled by the processor, and we don't store full card numbers on our servers.
6.2. Automatic renewal. Paid plans renew automatically at the end of each billing period (for example, annually) and are charged to your payment method until you cancel. The regular yearly price is $99.99. Before you subscribe, we will show you the price, billing frequency, renewal terms, and how to cancel, and by completing your purchase you expressly consent to those terms. We keep a record of that consent.
6.3. Cancellation. You can cancel online at any time in your account settings or billing portal, without contacting anyone. Cancellation takes effect at the end of the current paid period, and you keep access until then. If you cancel before a renewal charge, you won't be charged for that renewal.
6.4. Renewal reminders. For annual plans, we will send you a reminder before you are charged again, describing the plan, the amount and frequency of the charge, and how to cancel.
6.5. Price changes. If we change the price of your plan, we will notify you clearly (for example, by email) between 7 and 30 days before the new price takes effect, and tell you how to cancel. For Founding Members, that email will be sent 30 days before the renewal at the new price (see Section 6.11(e)).
6.6. No refunds; your exclusive remedy for paid-plan problems. Payments are non-refundable, and we don't give refunds or credits for partial billing periods or unused time, except as stated in Section 5.4, for billing errors or duplicate charges, or where the law requires a refund. You can cancel anytime under Section 6.3, and you keep access until the end of your paid period. If a paid feature did not work as described, or a charge did not match what was shown at checkout, your sole and exclusive remedy against Fixinary is a refund of the fees you paid for the affected billing period. This Section applies to the fullest extent permitted by law. It does not limit any right or remedy that the law does not allow to be waived or limited (see Section 11).
6.7. Failed payments. If a charge fails, we may retry it, notify you, and suspend paid features until payment succeeds.
6.8. Promotions. Promo codes and credits are subject to the terms shown with the offer (eligibility, expiration, redemption caps, and limits on combining offers). They have no cash value unless the law requires it. We may cancel codes or rewards obtained through fraud or abuse. If a free trial or promotion converts to a paid plan, we will tell you before you sign up and how to cancel before you're charged.
6.8A. Referral rewards. Only members with a paid subscription can earn referral rewards. Free-plan users do not earn referral months or other referral perks. If you have a paid subscription and someone you refer buys a paid subscription, you earn 3 free months of Fixinary for that person. A referral earns nothing if the person only signs up for the Free plan. Bonus months are calendar months (for example, March 15 to June 15). Free months are added after your current paid period. When your free months end, your next yearly billing period starts, and you are charged then unless you have canceled. Your Stripe receipt or billing portal may describe free months as a "free trial." You are not charged during them. If a referred person's payment is refunded or charged back, we may remove the free months it earned. Founding Members never earn referral months under this Section, during or after their first 15 months. Their only referral reward is the one-time bonus in the Founding Member offer.
6.9. Chargebacks. Please contact us first; we'd rather fix a billing problem than fight about it. Bad-faith chargebacks may lead to account suspension.
6.10. Taxes. Prices may not include applicable sales or use taxes, which we will add at checkout where required.
6.11. Founding Member offer (temporary). This Section applies only to Founding Members.
(a) Who qualifies. Founding Member status is limited to the first 100 people who buy it. Once 100 spots are taken, the offer closes. We may also close the offer to new signups at any time before then.
(b) What you pay. You pay a one-time $79.99 at signup. That covers 1 year and 3 calendar months of Premium.
(c) Renewal. Starting 1 year and 3 months after your purchase, your card is charged $79.99 per year, automatically, until you cancel, under Sections 6.2 through 6.5. You can cancel at any time before that first yearly charge, and you keep Premium until the end of your first 1 year and 3 months.
(d) Referral bonus in your first 15 months. Before your first yearly charge, you can earn a one-time bonus of 3 additional calendar months when someone you refer buys a paid subscription. You earn this bonus once, no matter how many people you refer. Free-plan signups don't count. The bonus months are added before your first yearly charge, which moves back by 3 months. After that, Founding Members earn no referral months.
(e) How long the founder price lasts. The $79.99 yearly founder price stays in place until we end (sunset) the founder plan. We may end the founder plan or change its price at any time. If we do, we'll email you 30 days before the renewal where the change first applies. That email will state the new price or plan and tell you how to cancel. You can cancel at any time before that renewal, and you won't be charged the new price. Section 6.5 also applies.
(f) Leaving ends founder pricing. If you cancel your Founding Membership or delete your account, you lose Founding Member status and can't get the founder price again, even if you return later.
7. Acceptable Use
You agree not to:
- use the Service for unlawful, fraudulent, or harmful purposes;
- upload content you don't have the right to share, or that infringes anyone's rights;
- upload photos or text containing other people's private information (faces, IDs, financial or account details, precise addresses of others), beyond what's needed to show a home problem;
- upload malware or interfere with the Service's security or availability;
- scrape, bulk-extract, or use the Service or its outputs to build a competing product or train a competing AI model;
- reverse engineer the Service or bypass access controls, rate limits, or paywalls (except where the law forbids that restriction);
- present Fixinary's outputs as licensed professional advice, a permit, an inspection, or a certification to others;
- use the Service to help with unlawful or unpermitted work, or to evade safety rules or building codes;
- abuse referral programs, promotions, or free tiers; or
- return to the Service after we've banned you, unless we reinstate you in writing.
We may investigate suspected violations and remove content or restrict access as reasonably necessary.
8. Ownership and Your Content
8.1. Our IP. The Service, including its software, design, branding, and the content we create, is owned by Fixinary or its licensors and protected by law. We grant no rights except those stated here.
8.2. Your license to use the Service. Subject to these Terms and your plan, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal or internal business home-troubleshooting purposes.
8.3. Your content. You keep ownership of what you submit, such as messages, descriptions, and photos ("User Content"). You give Fixinary a worldwide, non-exclusive, royalty-free, perpetual license to host, store, process, transmit, display, analyze, and otherwise use User Content and the information generated from it (including chats, diagnoses, photos, and outcomes) to operate, secure, support, and improve the Service, with no limitation.
Fixinary learns from its users. That is how the Service gets better. As a condition of using the Service, you agree that we may use User Content and related usage information to evaluate and improve our answers and safety checks, build and refine Fixinary's repair-guidance library, search, and retrieval systems, and develop, fine-tune, and train models and systems that Fixinary operates. This use is part of how the Service works and is not optional; there is no setting to opt out of it. If you don't agree, don't use the Service.
Where the law gives you rights over your personal information, such as the right to delete it, we will honor them. We will remove personal identifiers from information we retain for learning, and knowledge and improvements already derived from de-identified or aggregated information are not affected if you later delete your account. We do not sell User Content in a form that identifies you. We may create de-identified and aggregated data from User Content and usage information, and we may use, license, sell, or otherwise share that data with third parties for any purpose. We take reasonable measures to ensure that data cannot be associated with you or your household, we will not attempt to re-identify it, and we require anyone who receives it to agree to the same. Sending your content to the providers that power the Service (Section 9) is described in our Privacy Policy.
8.4. Feedback. If you send us ideas or suggestions, we may use them without restriction or compensation.
8.5. Outputs. We don't claim ownership of the text responses generated for you. That doesn't transfer any rights in the Service itself, and we don't promise that outputs are unique, non-infringing, or suitable for any purpose.
9. Third-Party Services
The Service relies on third-party providers, such as payment processors, authentication and database providers, AI model providers, and hosting providers. We may change providers. Their terms may apply to you in some cases, and we aren't responsible for their outages or acts outside our reasonable control. What we share with them is described in our Privacy Policy.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIXINARY DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT OUTPUTS WILL BE ACCURATE, COMPLETE, SAFE, OR CODE-COMPLIANT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THIS MAY NOT APPLY TO YOU.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIXINARY AND ITS OWNERS, OFFICERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
These limits do not apply to, and nothing in these Terms limits or excludes, liability for our fraud, willful misconduct, or gross negligence; for violations of law; or for any liability that cannot be limited or waived under applicable law, including California Civil Code Section 1668. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. For problems with paid plans and fees, Section 6.6 (refund as exclusive remedy) also applies.
12. Indemnification
You will defend, indemnify, and hold harmless Fixinary and its owners, officers, employees, and contractors from and against all claims, losses, damages, liabilities, costs, and expenses, including reasonable attorneys' fees and the costs of investigating and responding to misuse, whether brought by a third party or incurred directly by us, to the extent arising from (a) your User Content, (b) your violation of these Terms or the law, (c) your misuse of the Service, including fraud, abuse of free or paid plans, unauthorized access, or interference with the Service's security or availability, or (d) your infringement or misappropriation of another's rights. We may take over the defense of any matter at your expense. This Section does not limit any other right or remedy we have against you under these Terms or the law. We will not seek indemnity from you for our own gross negligence, willful misconduct, or fraud.
13. Governing Law
These Terms are governed by California law and, for Section 14, the Federal Arbitration Act, without regard to conflict-of-laws rules. If you live outside the United States, you keep any mandatory consumer rights you have under the laws of your home country.
14. Dispute Resolution
14.1. Talk to us first. Email legal@fixinary.com with a description of the problem and what you're asking for. Both sides will try in good faith to resolve it informally for at least 30 days before starting arbitration or court.
14.2. Binding arbitration. If we can't resolve a dispute informally, you and Fixinary agree to resolve it by binding individual arbitration rather than in court, except as stated below. This covers any claim related to these Terms or the Service, including claims that arose before these Terms. An arbitrator, not a court, decides whether a dispute is covered.
14.3. Rules and place. Arbitration is administered by the American Arbitration Association under its Consumer Arbitration Rules, whose rules and forms are available on its website. Hearings may be held by video or phone, or in the county where you live, at your choice. Fees are governed by the administrator's consumer rules. We will pay all filing, administrative, and arbitrator fees that those rules require the business to pay, and we won't seek fees from you unless the arbitrator finds your claim frivolous.
14.4. No class actions. To the extent permitted by law, you and Fixinary may bring claims only in an individual capacity, not as a plaintiff or class member in any class, consolidated, or representative action. If a court finds this waiver unenforceable for a particular claim, that claim (and only that claim) must be brought in court, and the rest proceeds in arbitration.
14.5. Exceptions. Either of us may (a) bring an individual claim in small-claims court if it qualifies, and (b) seek court relief to stop infringement or misuse of intellectual property or unauthorized access to the Service. A claim for public injunctive relief may be brought in court, and any such court case will be paused until any arbitration of your other claims ends.
14.6. Opt out. You may opt out of arbitration and the class waiver by emailing legal@fixinary.com with the subject line "Arbitration Opt-Out" within 30 days of first accepting these Terms. Opting out does not affect any other part of these Terms.
14.7. Court venue. For disputes that proceed in court (including if you opt out), the state or federal courts located in Los Angeles County, California have exclusive jurisdiction, except that you may bring a claim in the courts of the county where you live if the law gives you that right.
15. Changes to These Terms
We may change these Terms at any time. When we do, we will post the updated Terms on our website with a new "Last updated" date, and the changes take effect when posted or on any later date stated in the update. We may also notify you by email or in the app, but we are not required to.
By continuing to use the Service after updated Terms take effect, you agree to the updated Terms. If you don't agree, stop using the Service.
Changes to the price of a paid plan are governed by Section 6.5. Updated Terms do not change the outcome of a dispute that was already pending when they were posted. If we make a material change to Section 14 (Dispute Resolution), you may opt out of that change within 30 days of it taking effect by emailing legal@fixinary.com with the subject line "Arbitration Opt-Out."

17. General
17.1. Entire agreement. These Terms (including the Safety Notice) and the Privacy Policy are the entire agreement between us about the Service and replace earlier understandings on the same subject.
17.2. Severability. If a provision is unenforceable, the rest stays in effect, and the provision will be limited to the minimum extent needed to make it enforceable.
17.3. No waiver. Not enforcing a provision isn't a waiver of it.
